It is very important to know that negligence may consist of action or inaction. A person is negligent if he fails to act as an ordinarily prudent person would act under the circumstances. What constitutes negligence will depend on the facts of each individual case.

Workers’ compensation laws are designed to ensure payment by employers for some part of the cost of injuries or damages received by employees in the course of their work. These laws require the employer to provide a safe work place and proper equipment for their employees. The employer is liable for an employee’s acts of negligence, for the employer’s own gross negligence, and for extraordinary risks of work.
